1. Introduction
Welcome to FreshMintBureau ("we," "us," or "our"). These Terms & Conditions ("Terms") apply to your use of our yacht charter services and website at freshmintbureau.site (the "Service"), which is provided by FreshMintBureau.
By reserving a charter or using our Service, you consent to abide by these Terms. Should you object to any portion of these terms, you should not access the Service.
2. Service Overview
FreshMintBureau offers exclusive yacht charter services, which include but are not limited to:
- Charter rentals for the day
- Evening boat tours
- Business outings
- Exclusive gatherings
- Charters spanning multiple days
Service availability is contingent on multiple factors, and we have the authority to alter or discontinue services without prior notice.
3. Booking and Reservations
3.1 Booking Process
To make a charter reservation, you must:
- Have reached the majority age of 18
- Furnish current and complete information
- Remit the stipulated deposit indicated in your booking confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
Confirmation of your booking will be secured upon our receipt of payment and sending you a written confirmation. Service may be declined at our discretion.
3.3 Availability
The availability of charters is dependent on vessel access and suitable weather. We strive to accommodate your desired dates and times as accurately as possible.
4. Payment Terms
4.1 Pricing
All service fees are provided in € and include all applicable taxes, unless stated otherwise. Prices can change without prior notice.
4.2 Payment Schedule
- Deposit: Half of the entire charter cost payable at the time of booking
- Final Payment: Due two days before the departure of the charter
- Incidental fees (should they apply): Payable after the charter's conclusion
4.3 Payment Methods
We accept major credit cards, electronic bank transfers, and certified bank checks. Payments are processes through secure, encrypted services.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours before departure: Full return minus transaction fees
- Within 24 to 72 hours before departure: Half of the amount returned
- Less than 24 hours before departure: No return
5.2 Weather Cancellations
If our captain deems the weather conditions as unsafe, we will propose to either:
- Reschedule your charter to another available time at no extra cost
- Issue a complete return if rescheduling is unfeasible
5.3 Mechanical Issues
In case there is a mechanical issue with the designated vessel, we will try to supply a comparable alternative. If this is not feasible, we will issue a full return.
6. Safety and Conduct
6.1 Safety Requirements
All guests are required to:
- Heed all instructions given by the crew
- Utilize safety equipment when stipulated
- Inform about any medical conditions that could affect their safety
- Stay within the designated areas on the vessel
6.2 Prohibited Items
Items not allowed on the vessel include:
- Containers made of glass
- Illegal materials
- Guns or any form of weapon
- Excess refreshments (beyond reasonable personal consumption)
- Animals (unless prior approval is granted)
6.3 Conduct
We expect all passengers to behave respectfully. Any charter may be truncated without a refund if passengers' behavior endangers safety or disrupts other guests.
7. Liability and Insurance
7.1 Our Liability
We restrict our liability to the amount paid for your charter. We are not liable for:
- Injuries sustained due to passengers' negligence
- Personal property loss or damage
- Indirect, consequential, or exemplary damages
- Delays resulting from weather or other uncontrollable factors
7.2 Insurance Coverage
We uphold extensive maritime insurance encompassing our vessels and operations. Passengers should have their own travel and personal insurance.
7.3 Assumption of Risk
Engaging in our charter services signifies your acknowledgement of the inherent risks of maritime activities and your acceptance of responsibility for your own safety and wellbeing.
8. Modifications and Itinerary Changes
We have the right to change itineraries, paths, or schedules due to weather considerations, safety reasons, or operational demands. We will make efforts to provide similar alternative experiences whenever possible.
9. Force Majeure
We bear no liability for postponements, cancellations, or changes provoked by events beyond our control, including but not limited to:
- Extreme weather
- Natural catastrophes
- Legislative actions
- Closing of ports
- Vehicle breakdowns
10. Privacy and Data Protection
Your private data is managed as per our Privacy Policy. Use of our services signifies your agreement to our data collection and usage as detailed in our Privacy Policy.
11. Intellectual Property
All materials on our website, such as written content, visuals, symbols, and images, are safeguarded by laws of copyright and trademarks. Any replication, dissemination, or derivative creation is prohibited without our explicit authorization.
12. Governing Law
These Terms are regulated by laws in force within Spain. All disputes are subject to the jurisdiction of the courts within Barcelona, Spain.
13. Changes to Terms
We retain the prerogative to adjust these Terms when deemed necessary. Any amendments will be published on our website with a notification of the revision date. Use of our services after such changes implies acceptance of the new terms.
